Wills - Your Testamentary Wishes
We can make sure that you have an expertly drafted, valid Will which perfectly expresses your wishes. Making a Will ensures that your wishes are ultimately carried out and that your loved ones are looked after in the way that you intended.
A Will is important for everyone. If you don’t have a Will the Intestacy Rules apply. The Intestacy Rules don’t suit every family situation. In particular the Intestacy Rules don’t deal well with the following two common scenarios.
- Unmarried cohabitees with a property and perhaps have children together
- Married for a second time and who want to make adequate provisions for their spouse and children.
Estate Planning using Wills
Carefully drafted Trust Wills for couples can save you money. Some clients, for example, look to preserve estates and minimise the impact of care home fees. Some clients are looking for Inheritance Tax savings. We can review your estate for you and advise accordingly.
Lasting Powers of Attorney
A Lasting Power of Attorney governs who will manage your affairs in the event that you lose the capacity to do so for yourself. There are two types of Lasting Power of Attorney (LPA) – one for Property and Affairs and one for Health and Welfare. You can choose to prepare either or both.
Other Services
Creating a Lifetime Trust, Deputyship Applications, Probate Services
Lifetime Trust
Depending on your circumstances we will advise you on whether a trust is the right solution for your needs and create one for you. Typically these trusts are aimed at providing protection for the family home.
Deputyship Applications
A Deputyship Application to the Court of Protection is necessary if someone has lost mental capacity and he/she doesn’t have a Power of Attorney in place. We can attend to this process enabling a Deputy to manage the person’s finances.
Probate Services
It’s important to have expert help to fill in necessary legal forms for Probate. At a difficult time, this can take away the stresses and strains, avoid mistakes being made and ensure that any available tax relief is correctly claimed.
We are able to help Personal Representatives with either:-
- Obtaining the Grant of Representation thereby enabling the Personal Representatives to deal with the remainder of the estate themselves and therefore keeping costs to a minimum; or
- We can take the stress away completely and deal with the whole process from beginning to end.
We can provide fixed fee quotes in order to give peace of mind. Please contact us for a bespoke quote.
